摘 要
夫妻财产制又称婚姻财产制,是关于规范夫妻关系的法律制度,包括各种夫妻财产制的设立与变更,废止夫妻婚前财产制和婚后所得财产所有权的归属、管理、使用、收益、处分以及夫妻债务的清偿,夫妻家庭生活等费用的负担,婚姻关系解除时财产的清算和分割,对外财产责任等方面的法律制度.我国现行夫妻财产制度是法定财产制和约定财产制两者的有机结合的制度,以婚后所得共同制为法定财产制,习惯上成为了夫妻共同财产制.夫妻间的财产关系,是婚姻共同生活不可或缺的物质基础好保障,其不同于物权法、债权法上一般的财产关系,难以用普通的债权法或是物权法上的法律关系来规范以配偶身份为基础的夫妻间的财产关系.
随着经济体制改革的不断深入,人们的观念日益更新,夫妻间的关系越来越微妙,而夫妻间的财产关系也日益突出,而由于夫妻共同财产制具有其他财产制无可比拟的优势成为了我国的法定夫妻财产制,但也同其他财产制一样存在着内在的、固有的缺陷.本文首先对夫妻共同财产的种类和范围做了阐述,然后对我过《婚姻法》中有关于夫妻共同财产制度中存在的问题发表些个人的见解.

Abstract:
