No failure or omission to carry out or to observe any of the terms, provisions or conditions of this Annex shall give rise to any claim by one party against the other or be deemed to be a breach of this Annex, if such failure or omission arises from any event reasonably beyond the control of either party. Such event may be but is not limited to acts of God, breakdown of port machinery and equipment, civil unrest, strikes, lock-outs or labour disputes, war, battle and commotion or action of any relevant de-facto Government or any damage caused to any vessel during loading by the stevedores, whether by the stevedore's default or negligence or howsoever caused.
As soon as possible after the occurrence of any such event, the affected Party must give notice of the event of the event of force majeure to the other Party and the relevant provisions of this Annex applicable to the affected Party's obligations will be suspended for so long as the event of force majeure continues.
The affected Party must use all reasonable efforts to overcome or rectify such event of force majeure as quickly as possible. The liability of the affected Party to perform its obligations resumes as soon as it is no longer affected by the event of such force majeure.
